  1. mirkes.de's Tiny Hexer ("the software") license agreement:

  3. by unpacking or running any application from this package, you agree to be
  4. bound by and are becoming a party to this agreement. if you do not agree to
  5. all of the terms of this license agreement, you must destroy the package.

  7. markus stephany ("the author") grants you a non-exclusive license to use the
  8. software free of charge.
  9.  
  10. this agreement shall be interpreted in accordance with the laws of the
  11. federal republic of germany without application of that states choice of law
  12. provisions. any actions arising from this license or the use of this
  13. software shall be commenced and maintained in the brd (frg).

  15. * limitations on installation and use of the software:

  17. you may lend or copy and distribute the software free of charge to other
  18. people provided always that the terms and conditions of this agreement
  19. accompany to each copy so lent or distributed.

  21. you must not charge a fee, exchange goods or services, barter or otherwise
  22. profit in a commercial way from the lending, leasing, selling or
  23. distribution of the software.

  25. you may not modify, translate, reverse engineer, decompile, dissassemble any
  26. part of the software or create derivative works based on the software.

  28. * disclaimer of warranty:

  30. this software is provided "as is" without warranty of any kind, either
  31. expressed or implied, including, but not limited to the implied warranties
  32. of merchantability and fitness for a particular purpose. the entire risk as
  33. to the quality and performance of this software is with you. should the
  34. software prove defective, you assume the entire cost of all necessary
  35. servicing, repair, and correction.

  37. the author does not warrant that the functions contained in the software
  38. will meet your requirements or that the operation of the program will be
  39. uninterrupted or error free.

  41. under no circumstances and under no legal theory, tort, contract, or
  42. otherwise, can the author be liable to you or any other person for any
  43. indirect, special, incidental, or consequential damages of any character

  46. losses. in no event will the author be liable for any damages in excess of
  47. the amount the author received from you for a license to the software, even

  50. apply to liability for death or personal injury to the extent applicable law
  51. prohibits such limitation. furthermore, some jurisdictions do not allow the
  52. exclusion or limitation of incidental or consequential damages, so this
  53. limitation and exclusion may not apply to you. no dealer, agent, or employee
  54. of the author is authorized to make any modifications, extensions, or

  57. title, ownership rights, ownership of all derivative works, and intellectual
  58. property rights in the software remain with the author. the software is
  59. protected by copyright and other intellectual property laws and by
  60. international treaties. title and related rights in the content accessed
  61. through the software is the property of the applicable content owner and may
  62. be protected by applicable law. this license gives you no rights to such
  63. content.

  67. the license will terminate automatically if you fail to comply with the
  68. limitations described herein. on termination, you must destroy all copies of
  69. the software and documentation. your obligations to pay accrued charges and
  70. fees shall survive any termination of this agreement.
